1. WHO WE ARE
Honda305 Classifieds (“Honda305,” “we,” “us,” or “the Site”) provides an online venue where users may post and view classified advertisements related to vintage Honda motorcycles, parts, and related items.
2. WHAT WE DO — AND DO NOT DO
Honda305 Classifieds is a listing platform only.
We do not:
- buy, sell, ship, store, inspect, authenticate, or guarantee any item;
- act as a broker, dealer, agent, escrow service, or payment processor;
- participate in, supervise, or enforce transactions between users.
All transactions are strictly between buyers and sellers. Honda305 is not a party to any transaction.
3. ELIGIBILITY AND ACCOUNTS
By using the Site, you represent that you are legally able to form a binding contract in your jurisdiction and that all information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. USER CONTENT AND LISTINGS
Users may submit listings, text, images, and messages (“User Content”).
You are solely responsible for your User Content and for ensuring that it:
- is accurate and not misleading;
- does not infringe the rights of others;
- complies with all applicable laws and regulations.
Honda305 may remove, modify, or restrict User Content at any time, with or without notice, including in response to complaints, suspected fraud, or policy violations.
5. PROHIBITED ITEMS AND CONDUCT
You agree not to use the Site to:
- post illegal goods or services;
- list stolen items or items you do not have the legal right to sell;
- misrepresent the condition, provenance, ownership, or legality of an item;
- engage in fraud, deception, harassment, or abuse;
- interfere with Site operations, security, or access controls;
- scrape, harvest, or misuse Site data without authorization.
6. TRANSACTION SAFETY AND DUE DILIGENCE
You are solely responsible for evaluating listings and conducting due diligence.
Honda305 strongly recommends that users:
- verify identity and ownership before payment;
- inspect items in person or obtain independent inspection when appropriate;
- use secure and reversible payment methods;
- exercise caution when dealing with unfamiliar parties.
You assume all risks associated with any transaction initiated through the Site.
7. AS-IS SALES; NO WARRANTIES
All items listed on Honda305 are offered by users on an “AS IS” and “AS AVAILABLE” basis, with all faults.
Honda305 makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, authenticity, or accuracy.
8. NO LIABILITY FOR USER TRANSACTIONS
To the maximum extent permitted by law, Honda305 is not liable for:
- the quality, safety, legality, or condition of listed items;
- the truth or accuracy of listings or communications;
- disputes between users, including nonpayment, nondelivery, damage, or misrepresentation;
- losses arising from reliance on User Content or interactions with other users.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Honda305’s total liability for any claim related to the Site shall not exceed the greater of:
- one U.S. dollar (USD $1), or
- the amount paid by you to Honda305, if any, during the twelve (12) months preceding the claim.
Honda305 shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Honda305 and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- your use of the Site;
- your User Content;
- your violation of these Terms.
11. INTELLECTUAL PROPERTY
The Site’s software, design, and branding are owned by Honda305 or its licensors and may not be copied, modified, or reused without permission.
User Content remains the property of the user who posted it, subject to the license below.
12. LICENSE TO DISPLAY USER CONTENT
By posting User Content, you grant Honda305 a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content
